Terms of Service for Lumvo

1. Introduction and Acceptance

Welcome to Lumvo. These Terms of Service ("Terms") govern your access to and use of the Lumvo mobile application ("App") developed and operated by Viktoria Golovina ("I," "me," or "my").

By creating an account, accessing, or using Lumvo, you agree to be bound by these Terms and the Privacy Policy. If you do not agree to these Terms, please do not use the App.

Lumvo is designed to:

Lumvo is NOT:

• ❌ An official SAT/ACT testing service
• ❌ Affiliated with any college or university
• ❌ A replacement for proper application preparation

3. Account Registration

3.1 Creating an Account

To use Lumvo, you must create an account by providing:

• A valid email address
• Your first and last name
• A secure password
• Accurate information during onboarding

3.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying me immediately of any unauthorized use
• Ensuring your information is accurate and up-to-date

3.3 Account Security

You agree to:

• Use a strong, unique password
• Not share your account credentials
• Log out from shared devices
• Notify me of any security breaches at support@lumvo.app

3.4 Age Requirements

• Users must be at least 13 years old
• Users under 18 should have parental consent
• I reserve the right to request proof of age

4. Subscription and Payment Terms

4.1 Free Trial

Lumvo Premium offers a 3-day free trial:

• Trial starts immediately upon subscription
• You can cancel anytime during the trial
• If you don't cancel, you'll be charged after 3 days
• Only one free trial per user

4.2 Subscription Pricing

Lumvo Premium:

• Price: $4.99 USD per week
• Billing: Charged weekly after trial ends
• Auto-Renewal: Automatically renews unless cancelled
• Payment: Processed through Stripe

4.3 Payment Processing

• Payments are processed by Stripe, Inc.
• By subscribing, you authorize recurring charges
• Payment will be charged at confirmation of purchase
• You must provide valid payment information

4.4 Auto-Renewal

Your subscription automatically renews unless:

• You cancel at least 24 hours before the renewal date
• Your payment method is declined
• Your account is terminated

Renewal charges:

• Occur within 24 hours prior to the current period's end
• Are charged at the then-current subscription rate
• Require valid payment information on file

4.5 Cancellation

You can cancel your subscription at any time:

• Go to Settings → Manage Subscription
• Or through Stripe's billing portal
• Cancellation takes effect at the end of current billing period
• You retain access until the period ends
• No refunds for partial periods

4.6 No Refunds Policy

4.7 Price Changes

I reserve the right to change subscription prices:

• You'll be notified at least 30 days in advance
• Changes apply to new subscriptions and renewals
• Continued use after price change means acceptance
• You can cancel before the new price takes effect

4.8 Taxes

• Prices may not include applicable taxes
• You are responsible for any taxes, duties, or fees
• Taxes are based on your billing location

5. User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use Lumvo:

• For lawful purposes only
• In accordance with these Terms
• Respectfully and appropriately
• Without interfering with others' use
• Understanding it's a game, not a professional service

5.2 Prohibited Activities

You may NOT:

Security Violations:

• Hack, compromise, or circumvent security measures
• Access other users' accounts without permission
• Distribute viruses, malware, or harmful code
• Reverse engineer or decompile the App

Content Violations:

• Post false, misleading, or fraudulent information
• Impersonate others or misrepresent affiliations
• Share inappropriate, offensive, or harmful content
• Violate intellectual property rights

System Abuse:

• Overload or interfere with App infrastructure
• Use automated tools (bots, scrapers) without permission
• Attempt to gain unauthorized access to systems
• Exploit bugs or vulnerabilities for gain

Commercial Misuse:

• Resell or redistribute the App
• Use the App for unauthorized commercial purposes
• Frame or mirror any part of the App
• Remove copyright or proprietary notices

Community Violations:

• Harass, bully, or threaten other users
• Share others' personal information without consent
• Engage in hate speech or discrimination
• Spam or send unsolicited messages

5.3 Consequences

Violation of these Terms may result in:

• Warning or account suspension
• Immediate account termination
• Legal action if necessary
• Reporting to authorities for illegal activities
• No refunds upon termination for violations

6. Intellectual Property Rights

6.1 Lumvo's Intellectual Property

I own all rights to:

• The Lumvo app, design, and code
• Lumvo logo, branding, and trademarks
• All content I create (practice tests, prompts, etc.)
• The "Lumvo" name and related marks

You may NOT:

• Copy, modify, or distribute the App
• Use Lumvo branding without permission
• Create derivative works
• Remove proprietary notices

6.2 Your Content

You retain ownership of content you create:

• Essays you write
• Profile information and bio
• Photos you upload
• Messages you send

License to Me: By posting content, you grant me a license to:

• Display your content in the App
• Store and process your content
• Use anonymized content for analytics
• Share your public profile information with other users

Your Responsibilities:

• You own or have rights to content you post
• Your content doesn't violate others' rights
• You're responsible for any content you share
• I am not responsible for the quality or accuracy of your content

6.3 Feedback and Suggestions

If you provide feedback, suggestions, or ideas:

• I may use them without obligation to you
• You grant me unlimited rights to such feedback
• No compensation is owed for feedback

8.4 Essay Feedback

AI Essay Feedback:

• Provided for guidance and suggestions only
• NOT a guarantee of essay quality or acceptance
• Essays may still be rejected by colleges
• You are responsible for final essay content
• I am NOT liable for essay outcomes

8.5 College Recommendations

College Matching:

• Recommendations are suggestions based on your profile
• NOT guarantees of admission or good fit
• You must research colleges independently
• Recommendations may be inaccurate or incomplete
• I am NOT responsible for college selection decisions

8.6 Community and User Content

• I am not responsible for user-generated content
• Community features reflect user opinions only
• I do not endorse user content or recommendations
• Other users' advice is NOT professional guidance
• You use community features at your own risk

8.7 Technical Issues

I am NOT responsible for:

• Data loss due to technical failures
• App crashes or bugs
• Internet connectivity issues
• Device compatibility problems
• Missed deadlines due to App unavailability

9. Limitation of Liability

9.4 Exceptions

Some jurisdictions don't allow liability limitations. In such cases:

• Limitations apply to the maximum extent permitted by law
• I remain liable for gross negligence or willful misconduct
• Liability for death or personal injury is not limited

You agree to indemnify, defend, and hold me harmless from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

Examples:

• If a college sues because you plagiarized content from the App
• If another user sues you for harassment
• If you violate copyright laws
• If you commit fraud or misrepresentation

This means you'll pay my legal costs and damages if I'm sued because of your actions.

12. Termination

12.1 Termination by You

You can terminate your account at any time:

• Go to Settings → Delete Account
• Your data will be deleted within 30 days
• Active subscriptions will be cancelled (NO REFUNDS)
• This action is permanent and irreversible

12.2 Termination by Me

I may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in prohibited activities
• Your account is inactive for extended periods
• Required by law or legal process
• I discontinue the App
• For any other reason at my sole discretion

Notice:

• I'll try to provide notice when possible
• Immediate termination for serious violations
• NO REFUNDS upon termination
• You remain liable for any outstanding obligations

12.3 Effect of Termination

Upon termination:

• Your access to the App ends immediately
• Your data may be deleted per Privacy Policy
• Subscriptions are cancelled (NO REFUNDS)
• Outstanding obligations remain in effect
• You may NOT create a new account without permission

12.4 Survival

These sections survive termination:

• Payment obligations
• Intellectual property rights
• Disclaimers and limitations of liability
• Dispute resolution and arbitration

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim:

• Describe the issue in detail
• Allow 30 days for resolution
• We'll try to resolve disputes informally

13.2 Governing Law

These Terms are governed by:

• Laws of Illinois United States Of America
• Without regard to conflict of law principles
• Excluding the United Nations Convention on Contracts

13.3 Arbitration Agreement

For US Users:

• Most disputes will be resolved through binding arbitration
• You waive the right to a jury trial
• Class action lawsuits are waived
• Individual arbitration only

Exceptions:

• Small claims court (under $10,000)
• Intellectual property disputes
• Injunctive relief matters

13.4 Arbitration Process

These Terms and the Privacy Policy constitute the entire agreement between us regarding Lumvo.

14.4 Waiver

My failure to enforce any right doesn't waive that right:

You may not transfer your rights under these Terms:

• Your account is personal to you

• Understand subscription commitments
